1. When applying and interpreting the provisions of these general terms and conditions, the following terms and expressions shall have the meanings as indicated: “Hotelier” – the person providing accommodation and other services at Family Hotel “Sirena Palace”, namely: Building Stroigroup LLC; UIC 148073475 Address: Varna, Strandzha Str. 2, fl.4, apt. 12, phone: +359 892600170 Website: www.sirenapalace.com Email address: booking.serenapalace@gmail.com “Family Hotel “Sirena Palace”/Hotel” – Family Hotel “Sirena Palace” located in Obzor, Nesebar Municipality, where the Hotelier provides accommodation and other services, including the adjacent grounds, to which these general terms and conditions apply. Family Hotel “Sirena Palace” is a categorized tourist site, according to a categorization certificate № 10289/26.07.2017 issued by the Mayor of Nesebar Municipality.
“Premises” – a room in Family Hotel “Sirena Palace”, a studio in Family Hotel “Sirena Palace”, or an apartment in Family Hotel “Sirena Palace.”

“Client” – the Reservation Holder or a third party accommodated at Family Hotel “Sirena Palace” and/or using other services provided by the Hotelier based on a reservation.

“Child” – a person under 12 years old.

“Youth” – a person between 12 and 18 years old.

“Adult” – a person over 18 years old.

“Reservation” – the individual contract concluded between the Hotelier and the person wishing to use accommodation services in a room of Family Hotel “Sirena Palace” and/or other services offered by the Hotelier, to which these general terms and conditions apply. The reservation is considered made (i.e., the contract is considered concluded) when: a) a reservation request is sent by the person seeking accommodation to the Hotelier; b) an offer for reservation is sent by the Hotelier to the person seeking accommodation, containing the essential terms of the request; c) a confirmation of acceptance of the reservation is sent, and/or the deposit or full payment for the reservation is made within the specified time.

“Reservation Holder” – the person who requested a reservation and accepted the offer for a reservation sent by the Hotelier by sending a confirmation and/or paying the deposit or the full amount within the specified period. By accepting the reservation, the Reservation Holder commits to paying all fees for the reservation made in their name.

“Deposit” – a portion of the reservation fee determined by the Hotelier, indicated in the reservation offer, the payment of which within the specified period confirms the Reservation Holder’s agreement to the terms of the offer for accommodation in Family Hotel “Sirena Palace” and/or use of additional services. The deposit constitutes an advance payment under Article 93 of the Obligations and Contracts Act and serves as proof of the reservation’s occurrence (i.e., the conclusion of the accommodation contract).

“Pending Reservation” – a reservation for accommodation under which the Reservation Holder has the right to be accommodated in the calendar year following the year in which the reservation was made. In the case of a Pending Reservation, the Hotelier has the right to unilaterally change the fee for the services under the reservation in accordance with the price list adopted for the year in which the reservation services will be used.

“Arrival Date/Check-in” – the day on which the Hotelier commits to providing the services subject to the Reservation.

“Departure Date/Check-out” – the day by which the Hotelier commits to providing the services subject to the Reservation.

“Overnight stays” – overnight stays at accommodation establishments within the meaning of the Tourism Act.

“Group” – a package of Reservations for more than 6 rooms confirmed simultaneously, with individual reservations possibly including additional services offered at Family Hotel “Sirena Palace.”

“Additional Services” – all services other than Overnight stays offered at Family Hotel “Sirena Palace” to Clients under reservations or upon additional request.

“Additional Charges” – fees that the Reservation Holder owes the Hotelier for additional services used by Clients accommodated under the corresponding Reservation.

“Credit Account” – an account for the Additional Charges owed by the Reservation Holder for services used on the premises and in the commercial facilities of Family Hotel “Sirena Palace” by Clients accommodated under their Reservation. The Credit Account is maintained by the Hotelier and allows deferred payment of services by the Reservation Holder.

“Website/Site” – refers only to the website maintained by the Merchant and accessible at https://www.sirenapalace.com.
“Tourist Tax” – the overnight stay tax within the meaning of Chapter II, Section VII, Articles 61r – 61t of the Local Taxes and Fees Act.
“VAT” – Value-added tax under the laws of the Republic of Bulgaria.

“Fee” – a predetermined monetary penalty under Article 92 of the Obligations and Contracts Act owed by the Client for the loss and/or damage of property owned by the Hotelier, as well as for violations of these general terms and conditions and the hotel’s internal rules.

II. SCOPE OF APPLICATION

1. These General Terms and Conditions and rules apply to all Reservations for accommodation and the provision of additional services concluded with “Building Stroigroup” LLC, UIC 148073475, Address: Varna, Strandzha Str. 2, fl.4, apt. 12, in connection with and concerning accommodation in the property owned by the company, Family Hotel “Sirena Palace,” located in Obzor, Nesebar Municipality.

2. These General Terms and Conditions constitute an integral part of the Reservations for accommodation and additional services concluded between “Building Stroigroup” LLC and the Reservation Holders. Before submitting a reservation request and/or sending a confirmation of a reservation offer provided by the Hotelier, it is the responsibility of every person to familiarize themselves with these general terms and conditions for accommodation and the provision of additional services at Family Hotel “Sirena Palace.”

3. The Hotelier has the right to unilaterally amend these general terms and conditions. Amendments shall be made and communicated in accordance with Article 147b of the Consumer Protection Act and shall bind the Reservation Holders under the terms of that provision.

III. PREMISES

1. The building and rooms on the premises of Family Hotel “Sirena Palace” are constructed in compliance with all legal construction requirements in the Republic of Bulgaria and have been put into operation after obtaining all necessary usage permits.

2. The room numbering does not correspond to the floor on which the respective room is located.

3. The rooms in Family Hotel “Sirena Palace” are NOT equipped with a washing machine, ironing board, radio, or DVD player. The bathrooms do not have a Panic button or facilities for people with disabilities. An iron and hairdryer are provided upon request.

4. Family Hotel “Sirena Palace” is equipped with an elevator. The use of the elevator is prohibited for children under 7 years old WITHOUT supervision. Each room is equipped with air conditioning, a safe, and bath towels. The bathrooms do not have a Panic button or facilities for people with disabilities.

5. The photographic material of the accommodation on the Site and/or contained in promotional and/or informational materials is created for promotional purposes by photographing specific rooms that are part of Family Hotel “Sirena Palace.” The photographic material should not be determinative when selecting a room for accommodation, as the interior of the rooms in Family Hotel “Sirena Palace” is designed in different styles, color schemes, and furnished differently.

6. The television sets and equipment on the premises of Family Hotel “Sirena Palace” are passive elements. They receive television signals transmitted by satellite, and they do not emit any signals or electromagnetic waves.

7. Unless otherwise agreed, the Hotelier has the right to unilaterally determine the specific rooms in which accommodation under each reservation will take place. The Hotelier has the right to determine the number of Clients to be accommodated in each room, without exceeding the maximum accommodation capacity for each room specified in item 1 above.

8. The Hotelier may provide an additional bed if one is available at the time of request. An additional bed may only be provided at the Hotelier’s discretion if it is deemed appropriate for the specific room. A fee is payable for the additional bed unless the reservation price includes this service.

9. A request for a baby crib must be made when submitting the reservation request. The Client must specifically indicate the need for a baby crib. Only one baby crib may be placed in each room. The use of a baby crib is subject to a fee. Family Hotel “Sirena Palace” provides a limited number of baby cribs. If the Reservation Holder did not request a baby crib when submitting the reservation request, and there are no available baby cribs at the time of the request, the request may be refused.

10. Upon check-in, the Reservation Holder receives a key card and key, which can only be used to open the room they are staying in. The key card is used to activate the electricity in the room. The Reservation Holder must return the key card and key to the reception upon leaving Family Hotel “Sirena Palace.” In the event of a lost key card or key, the Reservation Holder owes a Fee.

11. Upon check-in, each room is provided with bed linen, towels, and hotel supplies according to the number of Clients accommodated in the room. Additional sets of bed linen, towels, and/or hotel supplies can be provided for a fee.

12. Rooms at Family Hotel “Sirena Palace” are cleaned daily, and bed linen and towels are changed after the third night. If the “Do Not Disturb” sign is displayed until 15:00, the room will be cleaned the next day.
